Terms and Conditions
Effective from: 16 October 2026
Last revised: 16 October 2026 | Revision: 2026-10-16
Key points
- Lessons are agreed in advance. Payment is normally due 48 hours before the lesson.
- You can cancel a lesson free of charge with at least 48 hours’ notice. Late cancellation and no-show charges reflect our net loss and cannot exceed the agreed lesson price.
- We do not add card processing fees. Unused advance payments can be refunded, less properly due charges.
- Check our availability before booking or changing a driving test. Use of the training car depends on an agreed booking and your readiness to drive safely.
- Either party may end tuition on the terms below. We will explain our reasons if we end the arrangement and refund unused advance payments.
These points are a guide. The full terms below explain the agreement and your rights.
1. Your agreement with us
1.1 Your agreement is with Tayton Driver Training Ltd (company number 15838578), referred to below as “TDT”, “we”, “us” or “our”. Our registered office and contact address is 18 High View Road, Leamington Spa CV32 7JB. You can contact us on 07535 793519, by email at info@taytondrivertraining.com, or by post at the address above. Our website is taytondrivertraining.com.
1.2 “You” means the learner receiving tuition. These terms apply to tuition purchased for personal use. An instructor provided by TDT delivers the tuition; TDT remains responsible for its obligations under this agreement.
1.3 We will provide a copy of these terms that you can keep and confirm the price, duration and arrangements before accepting your booking. A booking becomes binding when we confirm acceptance. Any special arrangements agreed with you form part of the agreement.
1.4 We use Total Drive as our shared teaching and account record. You will be asked to accept these terms through the app, which records booked lessons, payment history, available credit and learning progress. Please check your records and tell us promptly about any discrepancy. If you cannot access the app, contact us so that we can provide the information or agree alternative arrangements. App records do not override agreed arrangements or your legal rights.
2. Lessons and instruction
2.1 Your instructor will be a DVSA Approved Driving Instructor with current registration and will display their badge during paid tuition. We will provide instruction with reasonable care and skill, treat you professionally and follow applicable law and the DVSA Code of Practice.
2.2 We will agree each lesson’s date, start time, duration and meeting place with you. Lessons normally last at least 90 minutes and may be extended by agreement in 30-minute increments, up to 3 hours. Recurring appointments are subject to availability until agreed.
2.3 If we agree that the instructor will drive you to a suitable training area, that travel forms part of the booked lesson time. We will explain this before the booking is accepted.
2.4 If your instructor is late, we will make up the time or provide an appropriate credit or refund. If a change of instructor becomes necessary, we will discuss it with you. You may decline the replacement and receive a refund of unused advance payments.
2.5 We will discuss your progress and further training needs with you. Please tell us about any support or adjustments you need so that we can consider how best to provide suitable tuition. We do not guarantee a test pass or a particular number of lessons.
3. Prices and payment
3.1 We will confirm the price before accepting a booking. Payment is due by bank transfer at least 48 hours before the lesson unless we agree another arrangement. Payments received will be recorded in Total Drive, with a receipt available where needed.
3.2 Your first lesson must be paid for by that deadline. If it is not, we may cancel the booking and release the appointment after notifying you. Where we accept a first booking less than 48 hours before its start, we will agree the payment deadline with you.
3.3 We will give at least 14 days’ notice of changes to our standard lesson prices. Changes will apply to new bookings made after the stated effective date, not to bookings already accepted or hours already purchased.
3.4 Where we accept credit or debit cards, there is no additional fee for paying by card. We bear our payment provider’s processing fees and do not deduct them from refunds.
3.5 Only one introductory offer may be used per person: either the discounted taster lesson or the discounted first 10 hours, not both. Introductory offers cannot be combined or used consecutively.
3.6 Cancellation charges and other properly due outstanding sums will be invoiced with payment due within 14 days of the invoice date. This does not change the advance-payment deadline for lessons. We may suspend future tuition while overdue sums remain unpaid; please contact us promptly if you dispute an invoice.
4. Cancellations and missed lessons
4.1 You may cancel a lesson without charge by giving us at least 48 hours’ notice before its start. This means elapsed hours, including weekends and public holidays. You may cancel by any convenient means that clearly communicates your decision to us; no particular wording or form is required. For this ordinary lesson-cancellation policy, notice takes effect when received. We will acknowledge it as soon as reasonably practicable.
4.2 If you cancel with less notice or fail to attend, we may charge our net financial loss, up to the agreed lesson price. We will take reasonable steps to reduce our loss and account for costs saved and replacement bookings. We will explain any charge on request and may deduct it from your advance payments.
4.3 Please tell your instructor if you will be late. If you are not ready within 15 minutes of the start time and we cannot contact you or agree alternative arrangements, we may treat the lesson as a cancellation without notice. If you are late, this does not normally extend the booked finish time.
4.4 We may waive or reduce cancellation charges in exceptional circumstances, such as illness, accident or bereavement. Any remaining payment may be refunded or retained as credit, at your choice.
4.5 Subject to clause 4.6 where you are unfit to drive, if we cancel, you will not be charged for the lesson and may choose a refund or credit for any advance payment. If we give less than 24 hours’ notice, we will also credit an additional lesson of equivalent duration, except where cancellation results from instructor illness, vehicle unavailability or circumstances beyond our reasonable control.
4.6 We may postpone or stop tuition if weather, road conditions or your fitness to drive make it unsafe. If weather or road conditions prevent a lesson from being completed, you will receive a credit or refund for the unused time. If the reason concerns your fitness, we will consider reasonably whether any charge is justified by the circumstances and our actual net loss, subject to the limit in clause 4.2. This does not affect your rights where we are responsible for failing to provide the service.
4.7 The statutory cancellation rights in section 6 take precedence over this policy where applicable.
5. Advance payments and refunds
5.1 Block-booking hours should normally be used within 6 months of payment. We will consider reasonable extensions for illness, disability, agreed breaks or other exceptional circumstances, and extend the period where our availability or cancellations prevent their use. Unused credit is not automatically forfeited: we will contact you to arrange an extension or refund.
5.2 You may request a refund of unused advance payments at any time. We may deduct payments properly due for tuition already provided and valid cancellation charges. Unused hours are valued at the rate you paid; completed hours are not repriced solely because you do not complete a block.
5.3 Your payment history and available credit are recorded in Total Drive. Refunds will be made within 14 days of your request or the end of tuition, as applicable, normally to the original payer by the original payment method unless otherwise agreed with the relevant parties.
6. Statutory cooling-off rights
6.1 If you enter into a qualifying distance or off-premises contract, including a booking made online, by telephone or WhatsApp, you may cancel that contract without giving a reason within 14 days after the day it is made. This is separate from cancelling an individual lesson under section 4.
6.2 To exercise this right, clearly tell us that you wish to cancel by any convenient means. No particular wording or form is required. The optional statutory form at the end is provided for your convenience only. Sending your cancellation before the period expires is sufficient.
6.3 If you want tuition to begin during the cooling-off period, we will obtain your express request before starting. For an off-premises contract, that request must be in a form you can keep, such as an email or message. If you then cancel, you pay only a proportionate amount for tuition supplied up to cancellation, provided we have given the required information and obtained the required request.
6.4 You lose the right to cancel once the contracted service is fully performed only if you expressly requested the early start and acknowledged beforehand that full performance would end that right. Taking one lesson does not by itself end the right to cancel the unused part of a larger contract.
6.5 We will refund sums due within 14 days of being informed of cancellation, using the original payment method unless you expressly agree otherwise, without a refund fee. Nothing in these terms limits statutory cancellation rights, including any extended period that applies if required information was not supplied.
7. Your licence and fitness to drive
7.1 You must hold a valid provisional or full licence entitling you to drive the vehicle used. Before your first lesson, provide your licence details and a DVLA check code. Bring your licence to lessons and tell us before your next lesson about any disqualification, penalty points or other change affecting your entitlement. We may recheck your entitlement when reasonably necessary.
7.2 You must meet the legal eyesight standard and wear any required glasses or contact lenses. Tell us about health conditions or medication that may affect safe driving and any relevant change during tuition.
7.3 You must be fit to drive, wear suitable footwear and follow reasonable safety instructions. We may refuse or stop a lesson where it would be unsafe or unlawful to continue. Any charge will be assessed under section 4.
8. Vehicles
8.1 Our training vehicle will be roadworthy, appropriately taxed and MOT-tested where required, dual-controlled and insured for driving tuition and agreed driving tests.
8.2 Tuition in your own vehicle requires our agreement. You must provide evidence that it is roadworthy, legal and insured for paid instruction. Any instructor driving must also be covered. The vehicle must have appropriate learner plates and an additional interior mirror for the instructor. We may decline its use where it is unsuitable or unsafe.
9. Driving tests
9.1 You are responsible for booking and managing your tests and checking the DVSA confirmation details. Check readiness and our availability with your instructor before booking, changing or swapping a practical test. Advice to book does not guarantee readiness on the eventual test date.
9.2 Enter your instructor’s reference number where the booking service permits it, so the system can check recorded availability. This does not replace obtaining our agreement. Tell us the test date, time and centre at least 14 days beforehand, and notify us immediately of any later booking or change, whether made by you or DVSA. If you book without confirming availability, we cannot guarantee a vehicle or instructor.
9.3 We will confirm the price and time covered by your test-day booking before accepting it. Use of our vehicle requires our agreement and depends on you being safe and adequately prepared. New learners with a test already booked must first take an assessment. We may reasonably withdraw the vehicle for safety, licensing or readiness concerns and will explain these as soon as reasonably practicable. We are not responsible for a lost test fee caused by your lack of readiness or failure to meet DVSA requirements, except where our breach or negligence contributes to the loss.
9.4 Bring all documents required by DVSA. We will discuss test arrangements with you, including whether you want your instructor to accompany you and attend the debrief, subject to DVSA requirements.
9.5 If breakdown, instructor illness or another unforeseen circumstance affecting us prevents us from providing the agreed test vehicle, we will notify you promptly and try to arrange a suitable alternative with your agreement. If none can be agreed and provided and your test cannot proceed as a result, we will refund test-day services not supplied and reimburse the DVSA test fee lost, unless refunded or recovered elsewhere. This does not depend on continuing tuition with us and does not limit your other legal rights.
9.6 If DVSA cancels your test, any cancellation charge for our associated booking will be assessed under section 4. We will explain how to seek compensation from DVSA where available; eligibility depends on DVSA’s rules.
10. Ending tuition
10.1 You may end tuition at any time, subject to valid charges for booked lessons under section 4.
10.2 We may end tuition on reasonable grounds, including serious or persistent breaches of these terms, unsafe or abusive conduct, or a substantial breakdown in the working relationship that makes effective tuition impracticable. We will act reasonably, explain our reasons and normally discuss any concerns and give reasonable notice and an opportunity to resolve them. Serious misconduct or an immediate safety risk may justify ending tuition immediately.
10.3 If we cannot meet your learning needs, we will discuss this with you and consider reasonable adjustments where required before deciding whether tuition should end. Slow progress alone is not misconduct or lack of commitment.
10.4 If you neither attend a lesson nor arrange a future lesson for 4 weeks without an agreed break, we may contact you to ask whether you wish to continue. We will give at least 7 days to respond before ending tuition and releasing recurring appointments. This does not apply where our cancellations or availability caused the gap. Resuming tuition is subject to availability.
10.5 When tuition ends for any reason, unused advance payments will be refunded under section 5. We do not charge a fee simply for ending tuition.
11. Our responsibility and your legal rights
11.1 We are responsible for foreseeable loss or damage caused by our breach of this agreement or negligence. We do not exclude responsibility for failing to provide instruction with reasonable care and skill. A learner making a driving error does not, by itself, establish that the instructor is responsible for it.
11.2 We do not exclude or limit liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or anything else that cannot lawfully be excluded or limited. Your statutory consumer rights remain unaffected.
12. Personal information and professional standards
12.1 We handle your information in accordance with applicable data protection law. Our Privacy Policy explains how we collect, use, share and retain it and how to exercise your rights.
12.2 We maintain professional boundaries and a safe learning environment. Information may be shared where necessary and lawful to address a safeguarding concern or meet a legal obligation. Written permission to use learner photographs or information for publicity will be requested separately and is not a condition of tuition.
13. Complaints
13.1 Please raise concerns with your instructor or contact TDT using the details in section 1. We will consider complaints promptly, keep an appropriate record and explain our response. You may seek independent consumer advice from Citizens Advice or report concerns about your instructor’s professional service or conduct directly to DVSA. You do not have to complete our complaints process before seeking advice or contacting DVSA. These routes do not restrict your legal rights.
14. Changes and applicable law
14.1 We may revise these terms for future bookings and will provide the updated version before you agree to them. A revision will not retrospectively change an existing booking or prepaid block without your agreement, unless a change in law requires otherwise.
14.2 These terms are governed by the law of England and Wales. You retain any mandatory consumer protections and rights to bring proceedings in the courts available to you under applicable law.
Optional statutory cancellation form
Complete and send this form only if you wish to cancel a contract using the statutory cooling-off right in section 6. You may instead send any other clear statement of cancellation.
